Interesting. However, the situation was not changed so much, since the copyright in Japan is owned by the author completely, and you had to get the confirmation from the author, to copy the list of the dead people. Copyright law is describing clearly that the "news released for a fact" doesn't require the permission from the author, but many of Japanese (including layers) still wonder what information can be copied freely if you don't get the permission from the author.

Looking at the CRIC site that has a translation of the Copyright Law of Japan.


   *Article 18.* (1) The author shall have the rights to offer to and
   to make available to the public his work which has not yet been made
   public (including a work which has been made public without his
   consent; the same shall apply in this Article).[1]


This second part, about including works that have been made public without consent, would suggest that you have to verify that a work was made public legally the first time before you could republish it.
