Yes. So what? It's not a problem for the viewers in practice. Besides, it might very well be covered by a liberal, public license. For example, although it's not the default, O'Reilly will always permit a freely licensed distribution of content it publishes, upon request of the authors. If you know it is *not* publicly licensed, then it is your duty to report this showing to the copyright holders, I suppose.
