Even Microsoft can use Apache code without fear of legal AIDS, no need for clean-room reimplementation, etc, etc. It's not surprising that Microsoft can catch up. Cf. GM vs. Toyota; Toyota had a much longer row to hoe. It's actually more surprising that Apache can maintain as great a share of sites that otherwise run commercial software as it does. I think we should be proud of a 48% market share, regardless of the past.
