By "machines" you mean iPhone and maybe iPod, right?  I certainly
don't recall seeing that anywhere in the literature I've received with
my Macs, and I don't see how it could be enforced legally or
technically on the Mac.

In any case, that is still not evil, not by comparison with
rootkitting your o-kyaku-san.
