Not quite.

simon makes GPL software.  He sells the program (and gives a copy of the 
source) to Tux-san.  Pietro-san knows the software is GPL and tries to 
force Tux-san to give him a copy of the source.

I now understand that Tux-san does not have to give a copy of the source 
to Pietro-san, unless he wants to.
