The idea being a workaround for the viral aspects of the GPL? I suppose that observes the letter of the law if not the spirit, but like note in a subsequent post, if RMS really wanted freedom, he would have gone with the BSD license, which unlike the GPL, basically says "You can do anything with this, including fork the code base and make a proprietary version if you feel like," whereas the GPL says "You can do anything, but you can't do that." We know which is more truly free.
