In principle, states decide.  (Ah, subsidiarity!  Higashikokubaru
licks his lips and Hashimoto literally drools. :-)  In practice, some
do (Texas), some set minimum standards and let the districts decide
how to meet them (New York, if you want a "Regents' diploma" that
qualifies you for state universities), and some let the districts do
what they damn please (New York, if you don't want a university
entrance qualification).

IIRC in New York there were no Regents' examinations for foreign
languages, so it was a district-level decision.
