I would _not_ expect them to know.

I believe HTC has a contract with their suppliers that is the root of the issue.

The ADP2 (Google Dev Phone) suffers the same issue.  The camera and
bluetooth code is not open and is not in the AOSP repo.  All's there
is is a binary that is 1.6 compatible.

Cyanogenmod replaced that code and so that's why you can get a newer version.
