You need to do a bunch more reading on just where DRM is and is headed.
It's certainly not the case that the vendor of the original always
choses to add DRM or not. One example, from more than a decade ago,
is consumer DAT players; they always add a "no-copy" bit when doing a
digital copy, even from material that did not have it originally set. So
if you record something of your own, you can never copy from your own
copies of it. Similar things are being proposed for consumer computer
hardware.

No, as you point out, everybody has a choice. MS and Intel are moving
toward supporting very strong DRM, but they don't have to do that.
